A high court action over the refusal of a €150 plan to renovate the Clarence Hotel, Temple Bar is not going ahead.
Last August, the shareholders, which include Bono and his wife Ali Hewson, U2 guitarist The Edge, financier Derek Quinlan and developer Paddy McKillen, secured permission to challenge the council's refusal to extend the permission granted in 2008. A 150 million plan was granted to British architect Norman Foster in order to transform the property into a 141-bedroom five-star hotel and spa.
Last March, the Clarence Partnership sought to extend the the duration of the existing planning permission which is required to be renewed on a five yearly basis.
The council's refusal was on the grounds that the proposed eight-story building exceeded the maximum height permissible at the location on Wellington Quay under the Dublin City Development Plan.
When the action was mentioned before the High Court yesterday, John Gallagher SC, for the council, said the partnership was not proceeding and, on consent of both parties, the matter could be struck out.
No order for costs was required according to Mr Gallagher.
